It looks like James did the filing. I wouldn't put much weight on the "cruel and inhuman thing" -- back before no-fault divorce, each state had a very few bases on which one could file for divorce -- typically infidelity, cruel and inhuman, or not consummated. Now we have "irretrievably broken" and language like that. I should have said one thing a little more clearly -- if 2 people decided to get divorced, one would file the petition and be the petitioner, and would have to state one of the statutory grounds for divorce. I don't think anyone was the cruel one, they just got divorced. As for me, I'm gonna let my mom rest in peace.
